Directive principal of the state policy

भारत का सविंधान विश्व का सबसे विस्तृत सविंधान। है , जो की नागरिको एवं सरकारों दोनों को ही कुछ अधिकार और कर्तव्य प्रदान करता है। इसी प्रकार अगर हम सरकारों के दायित्वों की बात करे तो सविंधान मै इसके लिए कुछ विशेष प्रावधान किये गए है। और इन्ही को निति निर्देशक तत्व के रूप में जाना जाता है ।

सविंधान में निदेशक तत्व (DPSP in Constitution)-

सविंधान के हर भाग में अलग – अलग प्रावधानों को रखा गया है , इसी प्रकार भारतीय सविंधान के भाग – चार मे अनुछेद 36 से 51 तक निदेशक तत्व का वर्णन किया गया है , जो की राज्यों के लिए दिशा – निर्देश है की वह अपनी निति बनाते समय इन निर्देशों का धयान रखे । राज्य का अर्थ यहां भारत सरकार एवं समस्त राज्यों की सरकार सभी शामिल है । ये तत्व हमारे सविंधान में आयरलैंड के सविंधान से लिए गए है ।

निदेशक तत्वों की जरूरत (Requirement of DPSP)–

भारत एक लम्बे अरसे तक ब्रिटिश राज के अधीन रहा , जो की एक प्रकार का पुलिस राज्य हुआ करता था । आजादी के बाद हमारे सविंधान निर्माता एवं राजनेता इस पुलिस शासन को समाप्त करना जरुरी समझते थे और वर्षो की इस दासता को ख़तम करना उनका लक्ष्या था इसिलय उन्होंने एक कल्याणकारी राज की स्थापना का सपना देखा और जरुरी समझा की भारत एक ऐसा देश बने जो जनता का अधिक से अधिक भला करे सभी वर्गों का , सभी नागरिको का , सामान रूप से समाज में एक स्थान हो इसिलय सविंधान निदेशक – तत्वों का प्रावधान करता है ।

निदेशक – तत्वों की स्थिति (Condition of DPSP) –

राज्य को अपने नागरिको को अधिक से अधिक सुविधाए देनी चाहिए यही एक कल्याण कारी राज्य का लक्ष्य है परन्तु इसके लिए देश के पास भरपूर संसाधन होना भी जरुरी है पर जब भारत आजाद हुआ तब देश की हालत ऐसे नहीं थे की नागरिको सभी सुविधा दी जाय इसलिए इन तत्वों को राज्य की क्षमता पर छोड़ दिया गया जब राज्य की परिस्थि इनके अनुकूल हो तब राजय को ऐसा करना चाहिए और इसिलय कोई भी नागरिक इनके लागु करवाने के लिए कोर्ट नहीं जा सकता जैसे हम मौलिक अधिकार के लिए जा सकते है । परन्तु जैसे – जैसे राजय की आर्थिक हालत अच्छी होती जायगी , देश की जनता सजग होगी , तब हर सरकार को जनता का हित सर्वोपरि रखना होगा और ऐसे अपने आप ही निदेशक – तत्वों की पूर्ति हो जायगी ।

निदेशक – तत्वों की विशेषता (Quality of DPSP)-

जिस प्रकार मौलिक- अधिकार देश के नागरिको को राजनैतिक प्राधिकार देते है , उसी तरह निदेशक तत्व सभी नागरिको को सामजिक – आर्थिक न्याय प्रदान करते है , जो की सबके लिए जरुरी है । और इस 21 वी सदी में आज भारत की 70% से जायदा जनता साक्षर है तो बिना किसी न्यायलय की मदद के इन लोक नियोजन के कार्यो को सरकार को लागु करना पड़ता है , जो सरकार जनहित के कार्यो को नहीं करती उसका परिणाम वह चुनाव में देख लेती है , अंतिम शक्ति जनता के हाथ में है ।

लोककल्याण के उदारहण (Example of Wel-Fair)-

अगर हम लोककल्याण के बारे मे समझे तो इसे कुछ महत्व पूर्ण आर्टिकल को देख कर समझा जा सकता है , जैसे आर्टिकल 48 सरकार का कर्तव्य है की वह नागरिको को पर्यावण से संबंधित जानकारी दे , पर्यावरण सुरक्षा दे, इस पर नीतिया लागू करे अंतर्राष्ट्रीय नियमो का पालन करे । इसी प्रकार आर्टिकल 51 कहता है , सरकार अंतर्राष्ट्रीय शांति के प्रयास करे , आर्टिकल 40 के अनुसार पंचायत का घट्न करे , महिलाओ के लिए विशेष प्रावधान करे ऐसे कई सारे कार्य जनता के हित में सरकार करती है ।

मौलिक अधिकार और निति निदेशक तत्वों में अंतर –

सविधान निर्माताओं ने इन दोनों को एक साथ रखा था लेकिन इनमे से न्यायालय जाने का अधिकार केवल मौलिक अधिकार के मामले में ही है क्यूँकि नागरिको के लिए अधिकार जरुरी है सरकार को निदेशक तत्वों की पूर्ति के लिए मजबूर नहीं किया जा सकता अगर राजय के पास पुरे संसाधन नहीं है तो नागरिक कोर्ट नहीं जा सकते क्यूंकि निदेसक तत्व सरकार के लिए आदेश नहीं है, निर्देश है अगर किसी भी सरकार को वापस आना है तो वह अपने आप ही लोककल्याण के काम करती है क्यूंकि जनता को पता रहता है किस सरकार के द्वारा क्या काम किया जा रहा है इसलय अब निर्देशक तत्वों की वो बात नहीं है जैसा की आज़ादी के टाइम था की सरकार के पास ये कहना का रास्ता था की अभी तो संसाधन कम है पर आज देश की हालत बेहतर है इसलय सभी सरकार को ये धायन रखना होता है की किस वर्ग , समूह के पास किस संसाधन की कमी है कहि कोई वर्ग वंचित तो नहीं रहे गया है और अब तो सुप्रीम कोर्ट भी इस बात का धयान रखता है की सरकार किस प्रकार का काम कर रही है क्यूंकि कोर्ट को ये अधिकार है की वह सरकार की हर कार्य का निरक्षण करे और जनता को हमेसा ये बताने का सतत प्रयास करे की सरकार कैसा कम कर रही है ।
